Accommodating employees in the workplace can be challenging.
Questions often arise about what information an employer can request and what role the employee (and the employee’s medical provider(s)) plays in the accommodation process.
In this session, Daniel Weber and Anthony Espejo review the responsibilities of employers in the accommodation process and identify and discuss how medical providers can assist (and sometimes hinder) the process.
Topics covered in this session include:
- Disability and accommodation (the duty to accommodate and the procedural and substantive requirements)
- Limits to accommodation (undue hardship/bona fide occupational requirement)
- Absenteeism and accommodation
- Drug and alcohol disorder and accommodation
Following this session, participants will have a general understanding of the “duty to accommodate” imposed on employers via human rights law and the role of medical providers in the accommodation process.
